1. Scope and Operator

These terms concern use of this Lovable-hosted MAGASKAWE™ website and the information, designs, product presentations, media and external links provided here. They address all visitors and users of these website features.

The operator, referred to below as “MAGASKAWE™”, “we” or “us”, is:

2. MAGASKAWE™ and Spreadshirt

MAGASKAWE™ is an independent brand from Germany with its main shop in Germany. Spreadshirt serves the German-speaking region through that main shop. We do not operate our own US shop: our designs are available in the USA solely through the Spreadshirt Marketplace. This US/OZ website provides artwork, stories and product presentations, not direct sales, a cart or a checkout.

Clicking a product or shop link takes you to an external Spreadshirt site. A product purchase contract is concluded exclusively with the seller identified in that marketplace's legal information and checkout, not with MAGASKAWE™. The seller and terms applicable to a German Spreadshop are not necessarily identical to those for spreadshirt.com.

Spreadshirt handles ordering, payment, production, delivery, returns, refunds and purchase-related customer service under its own current conditions. Those conditions, privacy notices and mandatory consumer information apply to the purchase.

3. Product Presentations

Pictures, mockups, films and descriptions present our designs and direct visitors to Spreadshirt. Technical display settings, photography and creative production can cause differences between a presentation and the delivered item. Some models and product films are AI-generated or AI-edited.

The current Spreadshirt listing is decisive for product characteristics, materials, sizes, colors, prices, availability and delivery conditions. Any product or price information shown here is informational and is not an offer to conclude a product purchase contract with MAGASKAWE™.

Before placing an order, check the selected product, print, size chart and all purchase conditions directly on the relevant Spreadshirt page. A product button may lead to a collection or marketplace listing rather than a preselected checkout item.

4. Orders, Payment, Shipping and Returns

No merchandise purchase contract is formed through this website itself. We do not receive product payments or carry out production, shipping or returns for marketplace purchases.

Payment methods, taxes, shipping charges, delivery regions, delivery times, cancellation rights, returns, warranty remedies and refunds depend on the applicable Spreadshirt conditions and mandatory law at the time of purchase. We do not promise a universal return period or shipping entitlement independent of those conditions.

For an order, payment, delivery, return, complaint or refund, contact the Spreadshirt customer service identified on your order or use Spreadshirt Customer Help. Your statutory rights against the seller remain unaffected.

5. External Marketplace Responsibilities

The external marketplace's technical and organizational processes are operated by Spreadshirt and its service providers. MAGASKAWE™ does not control all aspects of its availability, payment processing, production, shipping or customer-service systems.

We cannot guarantee uninterrupted availability or error-free operation of an independent marketplace. Responsibilities for particular incidents are determined by the applicable contract and law, not by an absolute disclaimer on this website. Nothing here excludes our responsibility where the law imposes it.

6. Copyright and Intellectual Property

Website texts, designs, logos, illustrations, photographs, videos, music and other creative material are protected by copyright, trademark or other rights to the extent those rights apply. Rights remain with MAGASKAWE™ or the relevant rights holders unless explicitly stated otherwise.

Reproducing, modifying, distributing, publicly making available or commercially exploiting content outside legally permitted uses requires prior permission from the rights holder. Displaying a design here or purchasing a printed product does not transfer copyright, trademark or other intellectual-property rights to the purchaser.

7. Lawful Website Use

Use the website only for lawful purposes. Do not submit unlawful content, infringe another person's rights, attempt unauthorized access or interfere with the website or its services.

We prepare information with reasonable care and aim to keep it current, but cannot guarantee that every item remains complete, accurate or up to date. Content, designs, product links and features may be changed, added or removed, and the website may be temporarily unavailable or discontinued, subject to applicable obligations.

8. External Links and Embedded Content

Links may lead to Spreadshirt, the separate European MAGASKAWE™ website or other independent services. Their operators control their content, availability, terms and privacy practices. Linking does not automatically adopt their content as our own.

Some third-party content, including a YouTube player, appears within this website. Such services can establish their own connections and operate under their own conditions. Tell us about a specific unlawful or incorrect linked item so we can review it and take appropriate action.

9. Privacy and Redirection

After you follow a link to Spreadshirt, it may process additional information under its own privacy notices, including information for an actual order and customer service. This website's notice does not replace those notices or claim that MAGASKAWE™ is jointly responsible for every marketplace processing operation.

10. Liability and Mandatory Rights

Liability is governed by applicable law. Nothing in these terms excludes or restricts liability that cannot lawfully be excluded, including liability for intent, gross negligence, injury to life, body or health, or other mandatory statutory liability.

Website and marketplace responsibilities are separate. MAGASKAWE™ is not the contracting seller for the displayed Spreadshirt products and does not assume Spreadshirt's ordering, payment, manufacturing or delivery obligations merely by presenting designs or links. This does not remove any responsibility that applies to us under law.

Consumer protections, product-related statutory rights and other mandatory rights remain unaffected. These terms are not a waiver of rights or a guarantee of complete exemption from liability.

11. Changes to These Terms

We may update these terms to reflect legal developments or changes to the website, services or external offerings. The date above identifies this version. Changes do not retrospectively replace the contractual and legal conditions applicable to a product purchase already made through Spreadshirt.

12. Applicable Law

German law applies to these website-use terms to the extent a choice of law is legally effective. For consumers, this does not deprive you of protections under mandatory provisions of the law of your habitual residence where those protections apply. Spreadshirt purchase contracts are subject to their own applicable terms and mandatory law.

13. Final Provisions and Contact

If a provision is wholly or partly ineffective, the remaining provisions continue to apply to the extent permitted by law, and the relevant statutory rules apply in place of an ineffective provision.
